Syv endringer for et mer rettssikkert asylinstitutt


- Regjeringen vil i vår fremme et forslag for Stortinget om å redusere muligheten for å be om omgjøringsbegjæring for personer som allerede skulle reist hjem.
Dette sa Justisminister Grete Faremo til Klassekampen 23. april i år.

Foreningen av tolvte januar er skeptiske til innskrenkinger i asylsøkeres muligheter for å prøve sakene sine før vi har styrket rettssikkerheten i saksbehandlingen i UDI/ UNE.

En gjennomgang NRK nylig har gjort viser at 40 % av asylsaker som når Oslo Tingrett vinner frem, enten ved rettskraftig dom eller ved at Utlendingsnemnda gjorde om utvisningsvedtaket før saken gikk til doms.

Statistikk fra Advokatforeningens aksjons- og prosedyregruppe viser at de vinner frem i 71 % av sakene.

Utlendingsnemnda er ikke politisk ansvarlige, og verken Justisdepartementet eller regjeringen tar ansvaret for avgjørelsene som tas. Barn på Flukt-meldingen er bare ett eksempel på at det skapes svake og generelle signaler som det senere ikke tas politisk ansvar for.

Vi minner her om at UNE er et uavhengig, domstollignende forvaltningsorgan. De er altså ikke en del av det norske rettssystemet. Vi opplever en stor grad av politisk ansvarsfraskrivelse i utlendingssaker, og nå er det på høy tid at rettssikkerheten til mennesker i denne svært utsatte situasjonen tas på alvor og styrkes.

Vi har valgt å fokusere på sju punkter i denne omgang, uten at vårt videre arbeid er begrenset til disse:

1. Forbedring av ankomstprosessen

  • Asylsøker skal ved ankomst ha skriftlig Informasjon om asylprosessen på sitt lands hovedspråk. Ikke lesekyndige får tolk.
  • Torturskader og andre traumer, som kan få betydning i saken, skal dokumenteres av lege ved ankomst.
  • Opplysninger gitt ved ankomst skal tillegges liten vekt. Asylsøker gis mulighet til å korrigere opplysninger innen en måned, og før asylintervjuet.
 

2. Styrket saksbehandling

  • Norge skal følge UNHCRs anbefalinger.
  • Asylintervjuet skal videofilmes.
  • Tolker skal som et minimum være statsautoriserte. Tolkingen etterprøves ved stikkprøver.
  • Forvaltningens vurdering av asylsøkers dokumentasjon skal kunne etterprøves.
  • Homofile og konvertitter skal ikke returneres til land der de risikerer dødsstraff for sin legning eller tro. Slike saker bør avgjøres i nemnd.
 

3. En mer rettssikker ankeprosess

  • Advokater som tildeles asylsaker, må ha kompetanse på utlendingsrett og få betalt for tilstrekkelig tid.
  • Terskelen for bruk av nemnd skal senkes, og vurderingen skal være etterprøvbar.
  • Anke på første avslag i UNE skal behandles av nytt sekretariat og ny nemndleder / nemnd.
  • Saksbehandlingskapasiteten for hurtigbehandling av omgjøringsbegjæringer må styrkes.
  • I tilfeller hvor Landinfos representanter utgjør en del av saksbehandlingsprosessen bør det gis anledning og tid til å kalle inn uavhengig kompetanse via advokat for å legge frem alternativ landinformasjon. Nemndsmedlemmer må som hovedregel få tilsendt aktuell landinformasjon minimum to uker i forkant av nemndsmøter.
  • Organiseringen av klagesaksbehandlingen bør utredes med tanke på bedre overordnede løsninger.


4. Styrking av barnas rettigheter

  • Tiden er inne for å innvilge amnesti for de vel 600 lengeværende barna. De har ikke mer barndom å forhandle med. Deretter må det barns rettigheter styrkes.
  • Asylsaker som involverer barn, skal i hovedsak behandles i nemnd
  • Det må utarbeides ny forskrift som slår fast at barnets beste i hovedsak skal gå foran innvandringsregulerende hensyn.
  • Avslag må vise hvilke hensyn som er lagt til grunn og hvordan dette hensynet er veiet opp mot barnets beste.
  • Høy barnefaglig kompetanse skal benyttes i saksbehandlingen.
  • Barn skal ikke fengsles eller interneres.
  • FNs barnekomité og FNs torturkomité anbefaler at alle andre utveier skal prøves først . Dersom barn fengsles eller interneres, skal prosessen dokumenteres grundig. Barnefaglig kompetanse skal være tilgjengelig. Dersom barnet ikke kan uttransporteres innen 24 timer, skal barnet, eventuelt barnet med sin familie, kunne bringes tilbake til mottak dersom de ønsker dette.
  • Omsorg for enslige mindreåreige asylsøkere (EMA) mellom 15-18 år underlegges Barneverntjenesten.
  • Retur til internflukt eller "omsorgsbaser" i hjemlandet skal unngås dersom FN fraråder dette.


5. Rett til helsetjenester og arbeid

  • Papirløse skal ha rett til vanlig forebyggende og behandlende helsehjelp i primærhelsetjeneste og spesialisthelsetjeneste, lik Norges øvrige befolkning
  • Asylsøkere som har aktivt bidratt til å avklare sin identitet, skal ha arbeidstillatelse mens de venter på vedtak. Ved avslag beholdes arbeidstillatelsen fram til utreise.
 

6. Strengere kontroll med internering og fengsling

  • Lege- og psykologtjenesten ved Trandum utlendingsinternat skal være underlagt det offentlige helsetilbud, og dermed også ha ordinært offentlig tilsyn
  • Bruk av isolat skal kun gjennomføres med godkjenning av lege eller psykolog. Hensynet til asylsøkerens helse skal veie tyngst.
  • Trandum Utlendingsinternat er et fengsel, og skal på sikt overføres til det ordinære fengselsvesenet.
 

7. Oppfølging av situasjonen etter retur (monitorering)

  • Utlendingsmyndighetene må sørge for uavhengig monitorering ved tvangsretur til risikoland. Et nytt uavhengig organ bestående av kyndig landkompetanse og tett kontakt med aktuelle NGOer skal styre hvilke landområder dette skal omfatte.

Foreningen av tolvte januar mener det nå må innvilges amnesti for de vel 600 lengeværende asylbarna. Vedtaket på Arbeiderpartiets landsmøte om å avvente resultatet av en fremtidig evaluering etterlater igjen en fullstendig usikkerhet om hva som blir resultatet for barna, og utsetter nok en gang en avklaring på deres livssituasjon i landet de oppfatter som sitt hjemland. Dette er uholdbart for de barna det gjelder, og derfor er det nødvendig med et amnesti nå.

21. april ble det stemt over asylbarnas skjebne i Arbeiderpartiets landsmøte. Resultatet av voteringen ble dessverre ingen seier for rettssikkerheten til de lengeværende barna, eller for humaniteten. Barna er nok en gang kastet tilbake til forvaltningen, og i sin tur rettssystemet i de få tilfellene hvor de greier å løfte sin sak. De færreste har den nødvendige økonomien eller støttenettverk til å gjennomføre dette.
Det vi kan spore av framgang i vedtaket som ble fattet, er en formulering som viser at Arbeiderpartiet i fremtiden vil kunne jobbe med en endring av forskrift som klargjør terskelen for når barnets beste skal kunne trumfe innvandringsregulerende hensyn. Dette forutsetter at Utlendingsnemnda (UNE) sin interne evaluering viser at Stortingsmeldingen Barn på Flukt (BPF) ikke har den effekten den var ment å ha, uten at det er presisert hva som regnes som “tilstrekkelig endring”. Denne prosessen vil ta tid, og det er helt usikkert hva den vil bringe av endringer til gunst for barna.
I januar i år ble det lagt fram tall fra Justisdepartementet som hevdet at 40 % av sakene som involverer lengeværende barn siden BPF ble stemt igjennom hadde fått medhold. Dette dreide seg i realiteten om 23 saker hvorav 14 fikk avslag. Vi vet ikke om de 9 sakene som vant fram ble omgjort av hensyn til barnets beste, eller om noen av dem fikk opphold grunnet anerkjennelse av foreldrenes beskyttelsesbehov. Blant disse avslagene finner vi flere av de aller mest lengeværende barna. Dersom dette er symptomatisk på hva Justisdepartementet og AP sentralt vurderer som “en endring etter intensjonene” ser det mørkt ut for en styrking av human behandling på dette viktige området.
Vi forventer en svært grundig politisk og mer kritisk overvåkning av UNEs evalueringsprosess i tiden fremover.Tallmaterialet som legges til grunn fra forvaltningen, må være transparent og enkelt å måle.
Bare de siste ukene har Foreningen av tolvte januar opplevd at flere av barna som har levd i asylmottak i Norge i både ti og elleve år er akutt truet med deportasjon. Dette viser at BPF i realiteten ikke virker slik det ble signalisert at den skulle virke.
Høyesterett sendte i desember 2012 saken tilbake til politikerne, og UNE har ved flere anledninger uttrykt at meldingen er en svak rettskilde. Vedtak på omgjøringsbegjæringer viser at barnets beste fremdeles trumfes av innvandringsregulerende hensyn til tross for at barna både er født og oppvokst i landet. Vi registrerer at tiden virker imot de som trenger å skjermes.
Vi vil uttrykke anerkjennelse til AUF og enkelte fylkeslag i Arbeiderpartiet som i forkant av landsmøtet har kjempet en kunnskapsbasert og sterk kamp for å heve rettssikkerheten til denne utsatte gruppen barn. Dessverre løp likevel Arbeiderpartiets landsmøte fra ansvaret sitt, og har ikke benyttet muligheten til å formulere hvor terskelen skal gå for når og hvilke innvandringsregulerende hensyn som må vike til fordel for barnets beste.
En mulig regel- eller forskriftsendring vil ikke være klar til valget, og vedtakene burde vært fattet av de som er i posisjon nå.  Barna har ventet lenge nok og betalt dyrt for altfor mange kompromisser fra regjeringspartiene. Prisen de har betalt er barndommen sin.
Foreningen av tolvte januar mener derfor at tiden er inne for å innvilge amnesti for de vel 600 lengeværende barna.De har ikke mer barndom å forhandle med. I etterkant får det bli en politisk oppgave å beslutte hva som er tilstrekkelig endring av praksis for å sikre en human og rettssikker behandling av barna i fremtiden. Debatten om forskriftsendringer kan da bruke nødvendig tid uten at barna mister mer av sin barndom.

Må ta farvel med familien

- Dette er veldig vanskelig. Jeg vet ikke hva jeg skal gjøre.
Ordene tilhører Magomed Gezmakhmajev fra Tsjetsjenia. Lenge har han kjempet for at kona Dina Vagapova og sønnen Muslim (6) skal få bli værende i Norge sammen med Magomed, datteren Jasmina (3), bestemor Liza Gezmakhmajev og tante Ajshat Gezmakhmajev.
I 2009 kom Dinas svigermor og de tre døtrene hennes. Alle disse fikk opphold på humanitært grunnlag, unntatt Dina og sønnen deres som knapt hadde fylt ett år. Myndighetene mente at situasjonen i Tsjetsjenia ikke var alvorlig nok for henne. Dessuten hadde hun mulighet til å bosette seg i et annet sted i Russland, het det i endelige avslaget.

1 Improvement of the arrival process

3 A more legal safeguards appeal process
Attorneys granted asylum must have expertise in immigration law and get paid for sufficient time.
The threshold for the use of the Committee shall be made low, and the assessment must be verifiable.
Appeals on the first reduction in UNE will be considered by a new Council and new Board chair / committee.
Processing capacity for rapid treatment of commutation petitions must be strengthened.
In cases where Landinfo representatives are part of the case management process should be given the opportunity and time to call in independent practice as solicitor to put forward alternative locale. Board Members must generally receive relevant country information at least two weeks in advance of Board meetings.
The organization of the complaint procedure should be evaluated in terms of better overall solutions.

4 Enhancing children's rights

UN Committee Against Torture and the Committee recommends that all other expedients should be tried first. If children are detained or interned, the process must be documented thoroughly. Children Professional competence should be provided. If the child can not be deported within 24 hours, the child, or the child with his family, could be brought back to the reception if they wish.
Caring for unaccompanied minor asylum seekers (EMA) between 15-18 years subject to child welfare services.
Return to internal displacement or "care bases" in the country should be avoided unless the UN discourages this.

5 Right to health and work
Paperless shall be entitled to regular preventive and therapeutic health care in primary care and specialist, like Norway's remaining population
Asylum seekers who have actively contributed to disclose their identity, to have a work permit while waiting for the decision. The rejection remains the permit until departure.

6 Stricter control of detention and imprisonment
Medical and psychological services at Trandum Immigration Detention shall be subject to the public health, and thus also have extraordinary public supervision
The use of solitary confinement should only be undertaken with the approval of a physician or psychologist. The consideration of the applicant's health should weigh heaviest.
Trandum Immigration Detention is a prison, and will eventually be transferred to the regular prison system.

7 Monitoring of the situation after return (monitoring)
Immigration authorities must ensure independent monitoring of forced return to the country risk. A new independent body consisting of expert country expertise and close contact with relevant NGOs to determine which lands should include this.

What we can track the progress of the decision made, a formulation which shows that Labor will in future be able to work with a change of regulation that clarifies the threshold for when the child must be able to trump immigration regulation. This assumes that the Immigration Appeals Board (UNE) its internal evaluation, the White Paper on Children Escape (BPF) does not have the effect it was intended to have, without it being made clear what is considered "sufficient change". This process will take time, and it is quite uncertain what it will bring changes for the benefit of the children.

In January this year was presented to figures from the Ministry of Justice claiming that 40% of the cases involving children, as long as the current BPF was voted through had been upheld. These were, in reality, about 23 cases of which 14 were rejected. We do not know if the 9 cases that prevailed was converted for the sake of the child, or if any of them were granted due recognition of parental protection needs. Among these rejections, we find several of the most long remaining children. If this is symptomatic of what the Justice Department and the AP centrally considering that "a change as intended" looks bleak for an appreciation of humane treatment in this important area.

We expect a very thorough political and more rigorous monitoring of UNE's evaluation process in the future. figures are used as the basis of management must be transparent and easy to measure.

Oromo-Norwegians Stage Protest Against Neo-Neftegna TPLF in Oslo – 11 Arrested for Civil Disobedience

According to a Norwegian paper dagbladet.no and Google Translate service, Oromo-Norwegians protested against TPLF officials who were holding a meeting at the luxurious 4-Star Radisson Blu Scandinavia Hotel in Oslo, Norway, on April 28, 2013. The paper also said 11 were arrested for a short-period for civil disobedience, a form of nonviolent protest.
The Neo-Neftegna TPLF, which has been militarily occupying Oromiyaa since 1991, was forced to cancel its meeting. TPLF is using the overseas meetings to divert the attention from the ongoing land-grabs (farmland thefts), deforestation and gross human rights violations, including lack of press freedom, in Oromiyaa and elsewhere in the colonized South of the Ethiopian empire.

ብዙዎቹ ኢትዮጵያዊያን ከመድረሳቸው በፊት በገቡት የወያኔ ተወካዮች በመበሳጨቱ ወደ ሆቴሉ ለመግባት በነበረው ግብግብ፣ ምንም ዓይነት ሰው እንዳይገባ ተከለከለ፡፡ ይህንንም ተከትሎ የኢትዮጵያዊያንን ቁጣ ለማስቆም ከ15 መኪና በላይ የፖለስ ሃይል የተጨመረ ቢሆንም የጀግኖች ኢትዮጵያዊአንን ቁጣና እልህ መቋቋም አልቻሉም ነበር፡፡ አካባቢው የግልና ተቃውሞውም ህገወጥ እንደሆነ በማስረዳት  ከአካባቢው ገለል ለማድረግ ቢሞክሩም አልተቻለም፡፡ ኢትዮጵያዊያኑ በሆቴሉ የታደሙት የወያኔ ቅጥረኞት ወጥተው ካልሄዱ አካባቢውን ለቀን አንሄድም፤ ይውጡ እንለቃለን፤ ይውጡ እንለቃለን፤ ይውጡ እንለቃለን፤ ይውጡ እንለቃለንበማለት አብዘተው ጮሁ፡፡ ይህንንም ተከትሎ ሁለት ሴቶች እህቶቻችንና ዘጠኝ ወንድሞቻችን ለሰዓታት ታስረው የተፈቱ ሲሆን፤ ፖሊስም የተቃውሞውን ሓይለኝነት በማየት የወያኔ ተወካዮችንና የስብሰባው አስተባባሪዎች በጓሮ በር ማለትም በመኪና ማቆሚያ በኩል ከህዝብ ሰውረው ከሆቴሉ ሸኝተዋቸዋል፡፡

A group of concerned Oromo individuals made a series of meetings and arrived at a conclusion: to create an independent media (that host/serve diverse  Oromo) opinion and direct them to arrive at a consensus. It is not an exaggeration if we say we are very successful in creating Ayyaantuu.com. Today, it is the most widely read Oromo social media. In addition to the feedback we get from readers, our engineers also track, compare and analyze the traffic periodically and give us a feedback. Prominent Oromo intellectuals and leaders have also frequently gave us a feedback and encouraged us to keep up the good work.

Once again, we have taken our time and discussed with opinion leaders as to how to proceed to the next steps where by the social media need to take in order to transform the role of media in a liberation struggle. We came to a conclusion to implement the following ideas in the second phase to transform the Oromo people’s struggle.
1. Advocacy: Ayyaantuu managed to mobilize and network Diaspora Oromos through the social media. What Ayyaantuu has been doing mostly as introvert; we have been mostly communicating with one another. It helped to mobilize the people but that is not enough. We need to be extrovert and advocate our cause to the international community in general and donor nations in particular. Therefore, we must strengthen other Oromo advocacy. We must be able to finance our activists and scholars who are advocating for the Oromo cause.
2. Media: We need to bring the fragmented media outlets under one strong brand name. Instead of listening to what we want to hear over and over again from local media, we have a plan to reach the Oromo people people in Oromia. The Wayyaanee regime wants to isolate Oromo intellectuals from ordinary Oromos to keep them in the dark and rule them forever. To break this conspiracy of isolation, we must reach Oromia and educate Oromo people.
3. Promotion: We will continue promoting Oromo language, culture, art and literature. In addition, Ayyaantuu.com will soon promote Oromo products and services to introduce them to world markets. We will also promote inter-Oromo trade and business to build our capacities in every sector.
4. Resource Mobilization: We will mobilize our human and material resources to generate revenue effectively and efficiently by implementing our plans, in order to sustain all these projects, to assist Oromo community organizations and Oromo civil society institutions.
5. Preserving and promoting Oromo cultural heritages and social values, etc.
6. Publicize the protection of Oromo natural resources and the environment
7. Supporting refugees stranded in various parts of the world by generating funds for Oromo Relief Organizations
We honestly and humbly demand from all honest and sincere Oromos to own all these noble projects and cooperate and implement them and translate them into action. We are talking  for long time and let us now walk the talk. We were determined to continue and contribute something to Oromo cause and we are very glad for doing that. Now, no honest Oromo is interested in bickering and accusation. That has become history. We need action and we can do it together as an Oromo. We had the confidence when we started Ayyaantuu.com and it worked pretty well. We have also the confidence and capabilities to implement these and other projects as a united people. Let us do it together.

The 2011 trial of Woubshet Taye was at the time described unfair and was way
below the international fair trial standard under the controversial and draconian
anti-terrorism law designed to persecute and silence dissenting voices.
The Horn Times franticly tried to talk to TPLF officials in charge of prison
administration to find out the reason behind sending opposition prisoners
particularly Ethnic Oromos and the Amharas to Zeway during the known malaria
season, but none of them were willing to reply including the office of the man

Imprisoned Ethiopian Journalist Win the 2013 UNESCO-World Press Freedom Prize

Imprisoned Ethiopian journalist Reeyot Alemu has won the 2013 UNESCO-Guillermo Cano World Press Freedom Prize.
Imprisoned Ethiopian journalist Reeyot Alemu has won the 2013 UNESCO-Guillermo Cano World Press Freedom Prize. She is given the prize in recognition of her “exceptional courage, resistance and commitment” to freedom of expression. According to UNESCO’s news report, she was recommended by an independent international jury of 12 most outstanding media professionals.
Reeyot Alemu is one of the very rare outspoken Ethiopian women journalists. She bravely fought falsehoods, brutality, and oppression in Ethiopia, with pen — a power of words. She is currently serving a five-year jail sentence in Kality, a notoriously brutal prison of the authoritarian regime in Ethiopia. She was charged with ‘terrorism offences’ on June 2012, under the vaguely worded and broad-reaching Anti-Terrorism law, passed by the regime in 2009.
According to the Committee to Protect Journalists (CPJ), all of the charges against Reeyot Alemu were only based on her journalistic activities–emails she had received from pro-opposition discussion groups and reports and photographs she had sent to opposition news sites.
Reeyot Alemu is among a number of journalists who have been prosecuted under the anti-terrorism law in Ethiopia. According to Amnesty International, only during 2011 and 2012, over 100 journalists and political activists were arrested and prosecuted on charges of terrorism and other offenses in the country, for exercising their rights to freedom of expression. The actions that were the basis for such charges and prosecutions included writing articles critical of the government, calling for peaceful protest, and reporting on peaceful protests.
A Woman Born to Stand for the Truth
Born in 1980, Reeyot Alemu studied in Addis Ababa, the capital of Ethiopia. She received her BA in English Language and Theatrical Art from Addis Ababa University in 2005. Willing to risk her freedom and peace of mind, she began writing articles for independent newspapers in 2009, as a freelance writer.
Reeyot Alemu joined the now-defunct most prominent weekly newspaper called Awramba Times in 2010, where she worked as a columnist and wrote critically about the social and political crisis of her country. In 2011, she worked, among other roles, as a columnist for the weekly independent paper Feteh, which was later shuttered by the regime.
In 2010, Reeyot Alemu was able to found her own publishing house and a monthly magazine called “Change” that covered a wide range of political and social issues. However, after operating for a while, both of them were subsequently closed.
On June 21, 2011, Reeyot Alemu was taken from the school she taught, and arrested in Ma-ekelawi, an interrogation center, where dis-speakable torture is a normal practice of police and security officials in attempts to elicit confessions before cases go to trial. It was without charge. Four days before her arrest, she had written a sharp critique against the regime’s illegitimate fundraising methods for a dam project, and had apparently compared the late Libyan dictator Muammar Gaddafi with Ethiopia’s then-Prime Minister Meles Zenawi, who ruled the country for 21 years with a rod of iron.
Judged a “terrorist” by the tyrannical regime’s court, Reeyot Alemu was sentenced to 18 years in prison in January 2012. An appeals court, however, subsequently reduced the sentence to five years and dropped some of the charges.
Reeyot Alemu was offered clemency if she agreed to testify against journalist colleagues, who were arrested with her and accused by the regime of abetting terrorist groups. She, however, refused to do so and was consequently sent to solitary confinement as a punishment.
According to different sources, since her imprisonment in June 2011, the health of Reeyot Alemu has deteriorated. Recently, she has underwent surgery to remove a tumor from her breast. Her families reported that after the surgery she was forced to return to jail with no recovery time, and two days later she was, therefore, bleeding.
In 2012, Reeyot Alemu was the recipient of the prestigious 2012 Courage in Journalism Award that recognizes courageous actions of journalists around the world. She was given the prize for her “refusal to self-censor in a place where that practice is standard, and her unwillingness to apologize for truth-telling, even though contrition could win her freedom.”

በቤኒሻንጉል ጉምዝ ክልል ከ2000 ሺህ በላይ ትግሬዎች ባለይዞታ መሆናቸውንና ማንም ሳይነካቸው በሰላም እንደሚኖሩ፣ በቶጎ ወረዳ ከስልሳ በላይ ነባር የህወሃት ታጋዮች ሰፋፊ የእርሻ መሬት ወስደው በባለሃብት ደረጃ እንደሚገኙ የመኢአድ የስራ አስፈጻሚ ኮሚቴ አባል አስታወቁ። ከሌሎች ብሔረሰቦች ተለይቶ የዘር ማጥፋት ወንጀል እየተፈጸመበት ያለውን የአማራ ብሔረሰብ በድጋሚ ለማስወጣት መታቀዱንም በመረጃ ማረጋገጣቸውን ተናግረዋል።
በቦታው በመገኘት አስፈላጊውን መረጃ እንደሰበሰቡ ለአሜሪካ ሬዲዮ የገለጹት የመኢአድ ስራ አስፈጻሚ በክልሉ ከሚኖሩት የተለያዩ ብሔረሰቦች ተለይቶ የአማራ ብሔረሰብ እንዲፈናቀልና እንዲሰቃይ የሚደረገው በማዕከላዊ መንግስት ትዕዛዝ እንደሆነም አመልክተዋል።
መኢአድ ያሰራጨውን መግለጫ ተከትሎ በተዘጋጀ ጋዜጣዊ መግለጫ ማብራሪያ የሰጡት አቶ ሃይሉ ሻወል፣ ድርጊቱ በበታች የቀበሌና ወረዳ አመራር አካላት ተፈጽሟል መባሉን ተቃውመዋል።”ሰዎቹ እንዲወጡ ሲታዘዝ ያ ሁሉ ወታደር ከየት መጣ?” በማለት የጠየቁት አቶ ሃይሉ ሻወል፣ በርካታ የወያኔ ሰዎች በቦታው እያሉ አማራው ተለይቶ እንዲፈናቀል የበታች ባለስልጣናት በራሳቸው ውሳኔ ይህን ሊያደርጉ እንደማይችሉ ተናግረዋል። በማያያዝም በርካታ ተጨባጭ ማስረጃ ስለተሰባሰበ ጉዳዩን ወደ ዓለምአቀፉ የወንጀለኞች ፍርድ ቤት ለመውሰድ በዝግጅት ላይ እንደሚገኙ አመልክተዋል።
ባላቸው የተለያየ መስመር ፍርድ ቤቱ የሚቀበላቸውን ማስረጃዎች በማጣራት አስፈላጊ መረጃዎችን እንዳሰባሰቡ የገለጹት ኢንጂነር ሃይሉ ሻወል፣ “የሰውና የቪዲዮ መረጃ አለን። የመንግስት ወታደሮች ህዝብ ሲደበድቡ፣ መኪና ተገልብጦ ሰዎች ሜዳ ላይ ሲሰቃዩ፣ በግድ ሲፈናቀሉ … የሚያሳይ ተጨባጭ ማስረጃ አሰባስበናል። ወደ ክስ እናመራለን” በማለት መናገራቸውን የአሜሪካ ድምጽ ሬዲዮ (ቪኦኤ) አመልክቷል።
የመኢአድ የስራ አስፈጻሚ አባል በበኩላቸው የመንግስት ባለስልጣኖችና ካድሬዎች በኩምሩክ ሕዝብ በመሰብሰብ ማነጋገራቸውን ይጠቅሳሉ። እሳቸው እንዳሉት ህዝቡ “ለምን በዘራችን ሳቢያ ይህ ሁሉ ስቃይ ይደርስንባል?” በማለት ጠይቆ ነበር። የሰበሰቧቸው ባለስልጣናት “ክልሉ የናንተ አይደለም ውጡ” ሲሉ  እንደመለሱላቸው የጠቀሱት የስራ አስፈጻሚ አባል፣ በሌላ በኩል የተፈጸመው ህገ ወጥ የዘር ማጥፋት ተግባር የመንግስት እጅ ያለበት እንዳይመስል ለክልሉ ነዋሪዎች “አማራን አታስጠጉ፣ ከአማራ ጋር አትብሉ፣ ከአማራ ጋር አትጠጡ፣ ቤት አታከራዩ፣ ይህን ማድረግ ወንጀል ነው” በማለት መንገራቸውንና በዚሁ መነሻ ህዝቡ በክልሉ ያሉ አማሮች አካባቢውን ለቀው እንዲወጡ ጥያቄ እንዲያቀርቡ መመሪያ መሰጠቱን አመልክተዋል። ይህ የሚሆነውም ጥያቄው ከህዝብ የመጣ እንደሆነ ለማሳየት እንደሆነም አስታውቀዋል።

የቤኒሻንጉል ፕሬዚዳንት አህመድ ናስር
በዘር፣ በሐይማኖትና በአመለካከት አንድን ማህበረሰብ በከፊልም ሆነ ሙሉ በሙሉ ለማጥፋት መሞከር፣ ማሸማቀቅ፣ ሴቶችን መድፈር በዘር ማጥፋት እንደሚያስጠይቅ ያመለከቱት የመኢአድ የስራ አስፈጻሚ አባል፣ “ይህ ሁሉ ተፈጽሟል” በማለት ድርጅታቸው በዓለም አቀፉ ወንጀለኞች ፍርድ ቤት ክስ ለመመስረት ከድምዳሜ መድረሱን ገልጸዋል።
የቤኒሻንጉል ክልል ፕሬዚዳንት ለሪፖርተር በሰጡት መግለጫ ስህተት መሰራቱን ማመናቸውና ድርጊቱን የፈጸሙት ኪራይ ሰብሳቢ የወረዳና የበታች አመራሮች እንደሆኑ ማስታወቃቸው አይዘነጋም። በተመሳሳይ ለስራ ፈረንሳይ አገር በነበሩበት ወቅት ለጀርመን ሬዲዮ ጉዳዩን አስመልክቶ መግለጫ የሰጡት የውጪ ጉዳይ ሚኒስትር ዲኤታ ብርሃነ ገ/ክርስቶስ ፕሬዚዳንቱ ተፈጸመ ስላሉት ስህተት “የማውቀው ነገር የለም። አልሰማሁም። እኔ የማውቀው ደን ጨፍጭፈው በሃይል መሬት የያዙ መፈናቀላቸውን ነው” ብለዋል። ዶ/ር ያዕቆብ ሃይለማርያም ቀደም ባሉት ሳምንታት ከቤኒሻንጉል የተፈናቀሉትን ዜጎች አስመልክተው በሰጡት አስተያየት ወንጀሉ የዘር ማጥፋት ስለሆነ ክስ መመስረት እንደሚቻል አመልክተው ነበር።
መኢአድ በበደኖ፣ በአርባ ጉጉ፣ አረካ ቀደም ሲል የተፈጸሙትን የዘር ማጥፋት ወንጀሎች አያይዞ ለክስ እንደሚጠቀምበት አመልክቷል። በጥያቄና መልሱ ወቅት ከነበሩት ጋዜጠኞች መካከል “የተፈናቀሉት ተመልሰዋል። ለምን አትተውትም” በማለት ጥያቄ ያቀረቡ ጋዜጠኞች እንደነበሩ የቪኦኤው የአዲስ አበባ ዘጋቢ ጠቆም አድርጎ አልፏል።
